I laughed the second I got in here, love it man. :P



There's now two new mods on the official forums, so I guess we'll see how that works out. There's also a new forum for showcasing art and media so it looks like a few things are changing now.

You'd have to do it in Japan most likely (Comcept have a US business outlet but I don't think they handle money) where they hold jurisdiction. You're also likely not to win due to the nature of the funding considering that refunds under Kickstarter's rules are only given on project cancellation.



I think you'd be setting yourself up for being hit with more lawyer's and court fees than what you'd get back in the end.

I see... But if we gather all the people who wanted to get a refund, and do a class action, this would be viable no?

Before a case is even looked at by the court, they'd want to know that you'd done everything possible to retrieve the funds yourself. Considering you can ask your bank to perform a charge back, the case wouldn't even be looked at until that'd failed.

Yeah. You're right, and i don't know if we have sufficient people willing to try this. But i think that is possible to find a lawer in Japan to lead this case, but someone need organise everybody and this person need to speak japanese. It's hard, probably the effort will not payback, and will only work like a protest. But can happen.

If you still want to push the refund issue, you might want to contact Heredity, Char and Criscoknight. Heredity was the first one who proposed the idea of chargeback, but I haven't heard anything about them since their ban. Anyway, I think they are your best bet in pushing this issue.

For court, it depends on your local laws. Get a counsel for advice. I know on most States 300 USD is the minimum for a felony, so if you paid more than that amount, sue.

We also have to take into account that the laws in Japan and the U.S or depending where you were where you pledged may clash.  I don't think it's completely impossible to ask for a chargeback especially if the overall product ends up being shit.  Contrary to what others may say how kickstarter is not an investment or it's a risk, someone is taking our hard earned money and using it to make something and that something better be good.  If it turns out bad, you bet your ass I will demand a refund or a chargeback and get all the evidence I can.  However when it comes to the community issue there is not much I can help with since it is not affecting the overall product.  Of course this is just me talking here, I am not going to say anyone is wrong for demanding refunds still for feeling wronged in anyway.

the problem is moose it's poisoning the community, and this divide will never disappear because of it.
